Objective: Broadcasting Rights are one of the main sources of income for the football industry in the world. The aim of this study is investigation of the Broadcasting Rights in the Iranian football industry. Methodology: This study has a qualitative approach and the grounded theory was used as a research method. For gathering data high level documents were studied and 31 experts who were aware of this subject were interviewed. The validity of this research was examined and approved by the interviewers and then expert professors. The reliability of it is %76 which was obtained by using the methodology of the auditing result process. For data analysis the continuous comparison method in three stages was used: open, axial and selective coding. Results: Data analysis shows that the Environmental factors, Economic, political and cultural factors, Structural factors of football, Effective managerial factors(government), Behavioral and semantic factors, statutory and legal factors and the codification and Establishment Broadcasting Rights pattern are seven effective factors in the sale of Broadcasting Rights. Conclusion: Studies show that the continued refusal of Islamic Republic of Iran Broadcaster (IRIB) to pay the television Broadcasting fees will make the financial of football industry bankrupt. Also establishing the private television networks and the formation of bargaining committee with the government, parliament and the IRIB organization for sustained financial development of country football industry seems necessary.

The method of distributing income from the right to broadcast sports competitions in the IRIB has always been a source of challenge between this institution and sports institutions. On the one hand, the IRIB, based on evidence such as legislative precedent and the opinions of the Guardian Council in accordance with Article 175 of the Constitution and the principles of media administration, claims to allocate the majority of this financial source to the IRIB, and on the other hand, sports clubs and federations evaluate the current situation with the predominance of the level playing field and in favor of the IRIB based on intellectual property Rights and unfair legal principles and comparative models. The main question of this research is how and in what format a fair model can be determined to determine the share of each party to this dispute. The research findings show that although entrusting the initiative of preparing the regulations on this issue in the Seventh Progress Plan to the IRIB can create challenges such as conflict of interests for the IRIB, by forming an independent committee, determining specific shares, financial transparency, and continuous monitoring, a fairer model can be achieved. Considering the jurisprudential and legal foundations of the legal system of the Islamic Republic of Iran, by amending the interpretation of Article 175 of the Constitution and based on the jurisprudential rule of justice, it is possible to establish a fair distribution balance in this context through legislation by determining transparent criteria

Background: The purpose of the current research is to develop a plan for the transformation of the Broadcasting Organization with the approach of information technology governance and emphasis on ethics and citizenship Rights. Method: The current research was applied and conducted with a mixed (quantitative-qualitative) approach. In the qualitative part, the statistical population of the research included the senior managers of the Broadcasting organization, and 11 people were selected as a statistical sample using the purposeful sampling method. The data collection tool was a semi-structured interview. In order to analyze the data, coding was done using MAXQDA software. In the quantitative part, socio-statistics included managers and employees of the Broadcasting organization. In this research, 335 people were selected as a statistical sample using the random cluster sampling method. The tool for collecting information was a researcher-made questionnaire. In order to analyze the data, model fitting was done using confirmatory factor analysis and PLS software. Results: The findings of the qualitative section showed that 167 final extracted codes were grouped into 52 concepts. Also, the results of the quantitative section showed confirmation of the fit of the mentioned model. Conclusion: Based on the results, strategic categories; social and management as causal factors, categories of cost recovery systems, leadership of information technology, ethics of information technology, as contextual factors, categories of governance and political system; Cross training, knowledge management as intervening factors, pathological categories and effectiveness evaluation, legal and legal requirements, organizational architecture, strategic leadership and behavioral standards were introduced as strategic factors, and organizational, social, and individual consequences were introduced as consequences.

The intellectual property Rights of Broadcasting organizations, such as other intellectual property domains, is one of the most important issues for jurists, lawyers and broadcasters since 1961, when the international convention on protection of performers, producers of phonograms and Broadcasting organizations was ratified in Rome. This convention, which is also called Rome convention, grants the Broadcasting organizations̕ right of reBroadcasting, fixation, reproduction of fixations of broadcasts and the communication to the public of their television broadcasts. These organizations can further authorize or prohibit these actions. Unfortunately, this convention has never been revised till now, and is not coordinated with the technological advances such as webcasting and simulcasting broadcasts. This article is about to investigate if this type of broadcasts can be protected by law or not? And if they are protectable, which kind of Rights are suitable for webcasters? How does their Rights infringe? And what is the exceptions to the granted Rights in this scope.

In the last two decades and after the cold war & The emergence of new media, the media structure in most countries have witnessed dramatic changes which was achieved In the 20th century in the press domain and in the 21th century has been generalized comprehensively to the field of audiovisual media and has emerged new look to function and effectiveness of the media. In this article, after assessing various theories about the media, the media ownership structure changes in the world are assessed with focusing on the Radio and TV as an effective media.Referring to the two common patterns of public and private TV and radio Broadcasting which replaced the monopoly state Broadcasting in the most countries, the article points to the more advantages of this system than the exclusive model. By expressing the views, this article has investigated the experiences of 20 countries in transition from proprietary systems to the of media plurality. Moreover, by focusing on countries which have considerable cultural, political and geographical similarities with Iran, the study briefly indicated how these countries dealt with the challenges of restructuring screening. Finally, media plurality has been introduced as the most efficient media structure to achieve its objectives, including satisfaction of the audience, justified economically and providing national and social interests.

Todays, satellite Broadcasting has become one of the most important areas in international arena, so that global and regional satellite communications have overshadowed many communication activities and have experienced a new course of progress and path. The role and position of satellite television networks in the transmission of news and information is expanded that, on the one hand, has created a new type of communication in the world of media, and on the other hand, has transformed the traditional equations in this regard. Meanwhile, the cessation of satellite networks or the boycott of the media has deprived the audience of access to news and information, as well as political and cultural … views. Furthermore, unilateral boycott and cessation of satellite networks’ Broadcasting is not compatible with legal principles and rules. The present research, through a descriptive-analytic method and a comparative study in sources and foundations of international law and Islamic law, has analyzed and examined the practical components of live broadcast content of satellite programs.

The right to broadcast football is one of the well-know Rights of football in the world, however in Iran is still facing major challenges, even though there is an agreement between Broadcasting organization and football federation that includes apayment as the night to broadcast sports events to be done by Broadcasting organization, the unwillingness of this organization to fulfill it’, s obligations has caused controversy and despite the legal monopoly on the right to broadcast sports events for Broadcasting organization in the Law on the Implementation of Article 44 of the Constitution, the abuse of the dominant economic status is prohibited. Also, Broadcasting sports events, which means live or recorded coverage of sports events on television, radio and other broadcast media and is described by one or more sports commentators, is the communication bridge sports and the media. Now the main question is what is the solution of jurists and jurists in the field of Broadcasting Rights and termination of football Broadcasting contracts due to economic and political sanctions? Therefore, the purpose of this article is to provide jurisprudential and legal solutions by applying the football Broadcasting Rights of other countries to solve the problem of Iranian football Broadcasting Rights. To improve the football situation in the economic field, the existing gaps in the legal, economic, cultural and managerial fields must be filled, and these gaps can not be filled except with the help of jurists and lawyers to establish the legitimacy and legalization of Broadcasting Rights, so there is a need to form a committee. The technical and professional support of the government, parliament, the Radio and Television Organization and the Football Federation is required, and also to revive the right to broadcast by Iran, it should be deducted from the annual credits of the Radio and Television and added to the titles of the Ministry of Sports and Youth.

One of the most important things that can lead to the competitive advantage of the Islamic Republic of Iran Broadcasting (IRIB) organization in the turbulent environment of media organizations is the formulation and implementation of strategy or strategic management. Identifying strategic risks and preparing actions for them can increase the probability of strategic management success in the IRIB organization and increase the competitiveness of this organization in the media sphere of the country and the world. The purpose of this study is to identify and present a model of strategic risks in the IRIB. In order to achieve the research goal, grounded theory (GT) method have been used. The data required for the research in the qualitative section were obtained through in-depth interviews with fourteen experts. These people have been purposefully selected from among the deputies, consultants, managers, and experts of the IRIB organization whose organizational position or duties are related to the category of strategy, as well as university professors who are familiar with the category of risk and strategy. Data were analyzed in three stages of open, axial, and selective coding using Atlas.ti software. Based on this, 115 concepts were identified and categorized in the form of seven risks including structural risks, knowledge risks, production risks, managerial risks, technical and technological risks, financial risks, and human resource risks.

Requirement of a good model of Broadcasting as the most effective and important media in today’’s world is one of our necessities.In this study, based on Islamic principles, the Constitution and the ideas of Imam Khomeini and other Islamic Revolution theorists, set of desirable characteristics of a media model will be defined at first and then based on these features, this model is proposed for realizing the pattern.The current exclusive Broadcasting system is not desirable from the perspective of the Islamic Revolution and effectively supplying the political, security and cultural needs of the country; moreover, the pluralism of visual – aural media is required.In this research, the history of studies about desired structure of Broadcasting in Islamic Republic will be assessed at first; then, given to the current systems in other countries especially in seven selected ones and given to cultural, political, religious and legal characteristics of the regime, features of proposed model for Islamic Republic will be realized by interview with 14 former officials and experts in the field of desired Broadcasting system. The proposed model for fulfilling the desired media system in Iran will be offered based on these interviews.

In the beginning years, human accessing into communicational technologies, Broadcasting information and news be done domain of city, state and finally country, with developing and improving communicational technologies especially visual media (TV) and following with human accessing into telecommunication technologies (Satellites), domain of these technologies expanded throughout the world and it causes to provide developing process of misusing the new technologies both in the country and international domain. However from the positive aspects, the broadcasted programs from satellites are admirable but it is never guess this telecommunication tool with using principle in freedom of information and news circling in communication’s world caused losing the national cultures, political invasions and destructing moral values.Therefore, it is undeniable the harmful effects on live Broadcasting by the satellite in the scopes of political, economical and cultural interests and it is the fault of the organizations which assigned the international responsibility of the governments against the Broadcasting programs even if it is broadcasted by the private sector, then the damaged part can refer to the offender government for compensate the physical and moral damages and in case of both countries agreement, the authorized court for settling those disputes is International Court of Justice (ICJ) and the trial should be followed by the Article of Associations of ICJ.
